OFFICIAL SWEEPSTAKES RULES
NO APPLICATION OR PURCHASE NECESSARY. A PURCHASE OR APPLICATION WILL NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON.

1. PROMOTION PERIOD: The Buckle Card Back to School Sweepstakes ("Sweepstakes") begins 12:01 AM CT on September 7, 2009 and ends 11:59 PM CT on September 27, 2009 ("Promotion Period").

2. ELIGIBILITY: Sweepstakes open to legal U.S. residents who are 18 years of age or older as of date of entry, except employees and their families of The Buckle, Inc., and each of their affiliates, subsidiaries, advertising and promotion agencies, World Financial Network National Bank and Don Jagoda Associates, Inc. This offer is void wherever prohibited, and subject to all federal, state and local laws.

3. HOW TO ENTER: There are four (4) ways to enter:

(1) You will earn one entry by opening a Buckle Credit Card account via the Internet at www.buckle.com or at any Buckle store by close of business on September 27, 2009. Subject to credit approval. Normal Internet access, phone/usage charges imposed by your online/phone service will apply.
(2) You will earn one entry for each purchase transaction made on your Buckle Credit Card.
(3) You will earn one entry by registering your Buckle Credit Card account for account management via the Internet at www.buckle.com. Normal Internet access, phone/usage charges imposed by your online/phone service will apply.
(4) To enter without making a purchase, hand print your name, complete mailing address, telephone number and date of birth on a plain 3"x5" piece of paper and mail in a hand–addressed stamped envelope to: The Buckle Card Back to School Sweepstakes, P.O. Box 7893, Melville, NY 11775– 7893. Mailed entries must be postmarked by September 28, 2009 and received by October 5, 2009. Limit one mailed entry per envelope. Mechanically reproduced mailed entries are automatically void.

4. PRIZES: Grand Prize (1): $5,000, awarded in the form of a check. First Prizes (3): A $500 Buckle Gift Card. Second Prizes (20): A $100 Buckle Gift Card. Third Prizes (40): A $50 Buckle Gift Card. Fourth Prizes (100): A $25 Buckle Gift Card. Second, Third and Fourth Prizes will be delivered to winners within 4–6 weeks after winner determination. Limit one prize per person. Gift Card subject to additional restrictions/expiration dates. The total retail value of all prizes is $13,000.

5. PRIZE RESTRICTIONS & WINNER SELECTION: Grand Prize Winner (or his/her parent/legal guardians if winner is a minor in his/her state of residence) is solely responsible for all applicable federal, state and local taxes and will be required to provide his or her (or his/her parent/legal guardian's if minor in his/her state of residence) social security number. Sweepstakes prizes are non–transferable and no substitutions are permitted, except by Sponsor, who reserves the right, in its sole discretion, to substitute a non–cash prize of equal or greater value, if prize becomes unavailable. Buckle gift card prizes are redeemable for Buckle merchandise only and have no cash value. Winners will be selected on or about October 7, 2009, in a random drawing from among all eligible entries received. Drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization, whose decisions are final and legally binding on all matters relating to this Sweepstakes. Odds of winning will depend upon the number of eligible entries received. Winners will be notified by phone and/or mail.

6. GENERAL RULES: Potential Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Liability Waiver/Publicity Release (where legal) within ten (10) days of notification attempt. In the event of non–compliance, or if any prize or prize notification letter is returned as undeliverable, prize will be forfeited and an alternate will be selected. All taxes related to the prize are the responsibility of the individual winner. First Prize winners may need to verify mailing address within 10 days of notification attempt or the prize will be forfeited and an alternate winner selected. In the instance of co–applicant cardholders, the winner is the primary cardholder. Acceptance of prize constitutes permission to use winners' names, photographs and likenesses for publicity purposes without further compensation except where prohibited by law. Under no circumstances should entrants give their credit card account number, or any information regarding their account, over the phone in connection with this Sweepstakes. Entrants agree to bebound by these Official Rules and the decisions of the judges. BY ACCEPTING A PRIZE, WINNERS AGREE THAT THE SPONSOR, ITS SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THE SPONSOR'S OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, WILL HAVE NO LIABILITY WHATSOEVER FOR, AND WILL BE HELD HARMLESS BY WINNER FOR ANY LIABILITY FOR ANY INJURY, LOSS OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, DUE IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF A PRIZE OR PARTICIPATION IN THIS SWEEPSTAKES OR PARTICIPATION IN ANY SWEEPSTAKES OR PRIZE RELATED ACTIVITY. All entries become the sole property of Sponsor and none will be returned. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus tampering, bugs, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the automatic/online portion of the Sweepstakes and award prizes from among all eligible automatic/online entries received prior to cancellation or termination and all eligible mailed entries received, as applicable. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Entries generated by script or bot are not eligible. The Sponsor is not responsible for any lost, late, illegible, mistranscribed, postage–due mailed entries or for lost or unavailable network connections, computer online systems, servers, or providers, traffic congestion, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications or postage–due mailed entries or for problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any entry to be received by Sponsor on account of technical problems, any combination thereof, or otherwise, from participation in the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. All entries become the sole property of Sponsor and none will be returned.

7. JURISDICTION: The Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of Nebraska applicable to promotions fully carried out within Nebraska. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out–of–pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and winners hereby waive all rights to claim punitive, incidental and consequential damages and any other damages (including attorneys fees), other than for actual out–of–pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Each winner acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce the winner to execute any document and winners acknowledge that they have not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by the Sponsor and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. Each winner agrees that the invalidity or enforceability of any part of any document shall in no way affect the validity or enforceability of any of the remainder of that document.

9. SPONSOR/ADMINISTRATOR: This Sweepstakes is sponsored by The Buckle, Inc., Kearney, NE. The administrator of the Sweepstakes is Don Jagoda Associates, Inc., Melville, NY 11747.

The Buckle Back to School sweepstakes is offered, operated and administered by the Buckle. World Financial Network National Bank (WFNNB) issues Buckle credit card accounts. WFNNB is in no way affiliated with or responsible for the Buckle Back to School Sweepstakes. Any disputes concerning awards or benefits under the sweepstakes will not affect any payments or other obligations to WFNNB.
