Colbie Caillat Breakthrough Sweepstakes Official Rules

ELIGIBILITY: Open only to legal residents of the continental United States who as of 9/14/09, are 13 years of age or older (18 years or older for residents of the state of Maine). Employees of The Buckle, Inc. ("Buckle"), their affiliates, subsidiaries, advertising, promotion and inherent agencies, and their immediate family members and/or those living in the same household of such family members are not eligible. All U.S. federal, state and local laws apply. Void where prohibited.

NO PURCHASE IS NECESSARY TO ENTER OR TO WIN. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. ALL ELIGIBLE ENTRIES HAVE THE SAME CHANCE OF WINNING. BY SUBMITTING YOUR ENTRY, YOU ARE AGREEING TO THE TERMS AND CONDITIONS OF THE OFFICIAL RULES.

HOW TO ENTER:Beginning at 12:00 noon (CT) on 9/14/09 through 12:00 noon (CT) on 10/06/09, you may access the Colbie Caillat Breakthrough Sweepstakes ("Sweepstakes") by visiting buckle.com/sweepstakes. Complete all required information to register, and you will automatically be entered into the Sweepstakes. P.O. Boxes are not accepted. Limit one entry per person ("Entrant") per day. Any attempt by Entrant to obtain more than the allowable number of entries by using multiple/different email addresses, identities, or any other method will result in disqualification. Once submitted, entries become the sole property of the Sponsor and will not be verified or returned.

RANDOM DRAWING:
Winners will be selected in a random drawing on or about 10/09/09 from among all eligible entries received by Deloitte & Touche USA LLP, an independent judging organization whose decisions are final. Potential winners will be notified by email, mail and/or phone. Limit one prize per person.

PRIZES & APPROXIMATE RETAIL VALUES:

(1) Grand Prize: a 3–day, 2–night trip for winner and a guest to see Colbie Caillat perform live at the House of Blues in Los Angeles, California (Tuesday, October 27, or Wednesday, October 28). Trip includes: two round–trip airfares from a major airport nearest to winner's home, hotel accommodations at a sponsor–specified hotel (one room/double occupancy), two tickets to see Colbie Caillat live in concert at the House of Blues in Los Angeles, California and two backstage passes to meet Colbie Caillat, and a $500 Buckle gift card. Grand prize winner and guest are solely responsible for all other incidentals, taxes, and expenses not specified. Airfare is subject to availability and blackout dates. Accommodations provided are subject to availability. Grand prize winner and guest must travel together on one specified itinerary. All travel dates and arrangements are subject to change, availability, and Administrator/Sponsor's approval. If a minor is selected as the grand prize winner, the prize will be awarded in the name of his/her parent or legal guardian. Any minor traveling or attending a concert event must be accompanied by a parent or legal guardian. (A.R.V. $2,000 – but actual value of prize will vary based on point of departure and ticket availability at time of purchase.)

(3) First Prizes: $100 Buckle Gift Card

(50) Second Prizes: $25 Buckle Gift Card

Total approximate value of all prizes: $3,550.

Prizes consist of only the items specifically listed as part of the prize. Sponsor may substitute prizes at Sponsor's sole discretion. Buckle gift card prizes are redeemable for Buckle merchandise only and have no cash value.

WINNER NOTIFICATION:
Potential Grand Prize winners will be notified via phone at the number provided on entry and must be reachable between 9:00 a.m. CT and 2:00 p.m. CT and will be required to execute an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form and W–9 form by Sponsor's due date indicated in the Release Form (within 24 hours via fax and 5 days via mail of Grand Prize winner notification attempt). If no one is home to accept the call during the times stated above, no message will be left and Sponsor will select an alternate Grand Prize winner. Winner's guest will be required to execute a Release of Liability for receipt by Sponsor by the due date indicated in the Release Form (within 24 hours via fax and 5 days via mail of Grand Prize winner notification attempt). If any required documents are not returned within the required number of days or if any mail is returned as undeliverable without a forwarding address, then prize may be forfeited and an alternate winner may be selected at Sponsor's discretion, time permitting. If a minor wins the grand prize, the prize will be awarded in the name of his/her parent or legal guardian. Winner may make no substitution or transfer of prize. In no event will more than the stated number of prizes be awarded. Sponsor reserves the right to substitute prizes of equal or greater value. Buckle gift card prizes are redeemable for Buckle merchandise only and have no cash value.

GENERAL RULES:
All U.S. federal, state, and local taxes are the sole responsibility of each winner. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information connected with this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, or fraud beyond control of the Sponsor, which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at their sole discretion to cancel, terminate, modify or suspend the Sweepstakes. In such event, prizes will be awarded in a drawing from among all eligible entries received prior to such termination. CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the email address submitted at the time of entry (i.e., the natural person who is assigned to an email address by the organization responsible for assigning email addresses for the domain associated with the submitted email address). A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. In the case of a legal minor, the potential winner's parent or legal guardian may be the authorized account holder. If a dispute cannot be resolved, the entry will be deemed ineligible.

Acceptance of a prize constitutes permission to the Sponsor and its agencies to use winner's name and/or likeness for purposes of advertising and trade without further compensation, unless prohibited by law. By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the judges. By accepting a prize, winners agree to hold Buckle, their affiliates, subsidiaries, advertising, promotion and inherent agencies harmless against any and all claims and liability resulting from the acceptance, possession or use of any prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or by use or redemption of any prize.
