BUCKLE GIFT CARD TERMS
The following terms apply to Buckle gift cards:
YOUR PURCHASE, ACCEPTANCE OR USE OF A BUCKLE GIFT CARD CONSTITUTES ACCEPTANCE OF THESE TERMS. BUCKLE RESERVES THE RIGHT TO CHANGE THESE TERMS AT ANY TIME.
A Buckle gift card may be used for making purchases at Buckle locations or on buckle.com. Amounts of purchases will be deducted from your gift card until the balance reaches zero. Gift cards are nonrefundable and may not be redeemed for cash, unless required by law, or applied as payment to any account, including a Buckle Credit Card. Buckle is not responsible for lost, damaged or stolen gift cards or any unauthorized use of gift cards. Unauthorized resale is prohibited.
Buckle may refuse to accept a gift card and may take action, including balance forfeiture, for fraud, abuse or violations of these Terms. Buckle reserves the right to correct balances for clerical, billing or accounting errors.
If you used a Buckle gift card with another payment method, a Buckle gift card will be issued before refund to other payments. If you make a return without a receipt, a Buckle gift card may be issued at Buckle's discretion.
Disclaimer and Limitations on Our Liability
YOU USE BUCKLE GIFT CARDS AT YOUR OWN RISK. THE GIFT CARDS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE BUCKLE, INC. ("BUCKLE") AND ITS OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, SUBSIDIARIES, AFFILIATES, AGENTS, AND LICENSORS DISCLAIMS ALL WARRANTIES, CONDITIONS, AND REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THOSE RELATED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT AND THOSE ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BUCKLE BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, OR DATA) OR FOR THE COST OF OBTAINING SUBSTITUTE PRODUCTS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, HOWEVER CAUSED, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUCKLE'S TOTAL CUMULATIVE LIABILITY TO YOU OR ANY THIRD PARTY UNDER THESE TERMS, FROM ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY, WILL BE LIMITED TO AND WILL NOT EXCEED THE GREATER OF $100 OR THE LAST BALANCE HELD ON THE GIFT CARD GIVING RISE TO THE APPLICABLE DISPUTE.
Arbitration, Class Action Waiver, Governing Law & Severability
Except where prohibited by law, as to any dispute with Buckle regarding these Terms or this gift card you agree (i) to waive the right to trial by jury and the ability to participate in a class action; (ii) to resolve the dispute through negotiation with Buckle, and if agreement cannot be reached through negotiation, resolution will be sought on an individual basis only through binding arbitration in the State of Nebraska as conducted by the American Arbitration Association ("AAA"), JAMS, or any other company selected by mutual agreement of the parties; and (iii) that the laws of Nebraska will govern the substantive resolution of the dispute without regard to its conflicts of laws provisions. No arbitration under these Terms of use will be combined with any other arbitration.
The federal and state courts located within Nebraska will have exclusive jurisdiction to adjudicate any dispute arising out of these Terms or this gift card that cannot be resolved through arbitration. If any provision or portion of these Terms or gift card is determined to be invalid under any statute or rule of law, then it shall, to that extent alone, be deemed omitted, and the remaining provisions or portions shall remain in full force and effect.
